Sean “Diddy” Combs and his legal team are pushing to have one of the assault lawsuits against him thrown out of court. But if they are successful, it could set a new precedent that would affect many of the other lawsuits he is currently facing. This particular case revolves around a Jane Doe, who claims she was assaulted by Diddy during a charity basketball game in 1991. The case was filed under New York’s Victims of Gender-Motivated Violence Protection Law (GMVA), which has become the focus of Diddy’s defense.
At the center of the dispute is the date of the alleged assault and how it relates to the GMVA. The law was passed in December 2000, and in 2022, New York extended the statute of limitations for filing claims under this law from 7 to 9 years. This extension, however, has raised questions about whether victims can sue for incidents that happened before the law even existed.
According to Diddy’s attorney, Mark Cuccaro, the Jane Doe’s lawsuit should be dismissed because the GMVA law didn’t exist when the alleged assault took place in 1991. The victim, who filed the lawsuit in December 2022, claims she was attacked by Diddy at a charity basketball game at City College in New York. The key point that Diddy’s team is arguing is that the GMVA was passed almost a decade after the alleged assault, so it shouldn’t apply to this case.
Cuccaro further argues that even with the law’s recent amendment to extend the statute of limitations, it doesn’t allow claims based on incidents that happened before the law was created. In simple terms, they argue that victims can’t file lawsuits under a law that didn’t exist at the time of their alleged assault.
The timing of this legal battle is crucial, as the window for filing lawsuits under the GMVA just ended on February 28. Because of this, there has been a wave of new lawsuits filed against Diddy in the past couple of weeks. Some of these lawsuits come from other women who claim they were victims of assault, dating back decades.
Diddy has consistently denied the accusations against him. In his legal team’s official statement, they firmly maintain that the claims in the lawsuits are “entirely false and salacious.” They express confidence that he will be fully cleared of any wrongdoing if the case goes to trial. This defense is not new, as Diddy’s team has made similar statements in previous cases.
The lawsuit that is currently under review was filed by well-known attorney Tony Buzbee, who represents multiple clients who are suing Diddy. Buzbee is also handling several of the other high-profile lawsuits that have been filed against the music mogul in recent months. While Diddy’s legal team is hoping to dismiss the 1991 case based on their interpretation of the GMVA, Buzbee isn’t backing down.
In a response to the legal argument, Buzbee told the media that Diddy’s team is wrong on the law. He emphasized that case law overwhelmingly supports the victims in cases like this one, suggesting that Diddy’s legal strategy may not succeed in the long run. Buzbee is confident that the courts will side with the victims, rather than dismissing their cases based on technicalities related to the law’s timeline.

If Diddy’s motion to dismiss the 1991 lawsuit is granted, it could have major implications for the other cases against him. Many of the lawsuits filed against Diddy involve incidents that allegedly took place before the GMVA was passed in 2000. If the court rules that the law doesn’t apply to these incidents, it could dismiss many of these cases as well.
